I'm not 100% sure but I know a drunk is annoying,rude, and totally stupid!!

A crime is a general heading that covers both misdemenors and felonies (usually crimes punishable for 1year or more). In most states these crimes are considered misdemeanors, but they may me felonies if there are aggravating factors, like if the defendant is charged with this along w/ assault / battery or if the defendant was on probation or had a history of continuously being drunk in public. sometimes repeat offenses can turn into felonies depending on your state's criminal code.

You can be totally trashed and not be arrested in New York State. Unless you become disorderly or Drive.
