I was recently a witness to my brothers Hit and run accident. i workat my college bookstore and i was wondering if i can get fired for going to court. or is it a penalty? of federal law to lay off someone for attending a government court house?

as a witness, you should receive a summons to go to court. Show this to your boss when you request the time off.You shouldn't be penalized (except for the lost pay hours). If you did something wrong and had to go to court, they can penalize you by having you use you sick days, or vacation time. And if you don't have any, then they can fire you. Some bosses will just use that as your day off if you give them enough notice.

Have you been subpoenaed to appear? If so, they cannot fire you because you have been ordered to court.

If you are going for moral support and not because you were ordered to appear, you will most likely have to offer to take the day as a vacation day. If you don't have any, then they would be within their rights to terminate, if they chose to do so.

You should have received a subpoena REQUIRING you to attend this court session. You cannot ignore a subpoena and must attend. I would suggest you show your boss the subpoena you received. He is not required to pay you for time missed - but your job should not be in jeopardy.

If you notify your employer ahead of time, they should be able to make arrangements for you to be off work long enough to go to court. Keep in mind, they must maintain staffing to keep their business operating, so if you don't give them time to make staffing arrangements, you may put them in a bind covering for you. A little consideration goes a long way.

no you cannot get fired, just inform your job if you are going during your work hours...and if they ask get paperwork from the court stating that is where u were at on that day and time.

It helps if you were actaully issued subpeonea.

Also helps if you're tactful about with your boss (ask, don't demand)
