State laws differ. Here in Arizona, you need to pass a background security check to purchase a new gun. I don't know if immigration status is part of the criteria.
Anybody can purchase a used gun. There are no checks. This includes felons, the mentally insane, illegal immigrants, and homosexuals. The catch is that most of the above are NOT allowed to own guns by law. They can be arrested for possessing one. The seller will not be at fault.

You don't have to be a citizen to buy and own a gun! Somebody with a green card IS a legal resident, so as long as they meet the other requirements and criminal background check, there is no reason why they can't have a gun.
