No, she does not have to give her boss anything. She needs to file a complaint with the Louisiana Department of Labor.

If you want to email the Louisiana Department of Labor and tell them the details go to the link below and scroll down to the bottom of the page. Click on "Answer My Question". This will pull up your email program and fill in the email address of the department that can answer the question and tell your daughter how to proceed.

No!!! The reason she works for sub-minimum wage is because she gets tips. If she provides great service she has earned every penny of her tip money. That bastard of a boss didn't do a damn thing for it.
Exceptions: in some establishments it's customary for the wait staff to split a portion of their tips with other employees that help them service the guest (such as the bartender who gets your drinks, or the busboy who clears/set the table & brings bread, drinks, etc)

No. I'd quietly look for another job. Scumbags like this believe that people come to his restaurant for the food and not for the service. Otherwise they'd pay their people a decent wage. Your daughter is not going to put her heart into this job anymore after being treated like this. She should quit or this boss will think she's a pushover for this treatment.

While management may ask, so they can record it and report it to the IRS, they are not allowed to take it from her.

Some businesses have a tip-sharing policy. All tips go into a pool and are divided among all of the waiters. Also, it is customary to share a portion of the tip with the busboys, etc.

However, management does not get tips and your daughter does not need to share it with him. If he asks, say no. If she does, she should ask for a receipt so she can report him.

No..I've never heard of this either. I'd say the boss is ripping your daughter off. I'd be calling and asking questions.

No, waitstaff don't have to give any of their tips to their bosses, because they are paid such a miserable wage.
Straighten that bastard of a boss out, pronto!

no way! waiters don't have to pay anything to anyone. they keep what they make. If that boss doesn't stop ripping his employees off I say she should quit!

This is illegal. Report him to your local employment authorities. Additionally, she can sue.

Then she should find a new job.
