I no longer recieve Public asistant (welfare) but have a child support enforcement place on the father of my two kids...my question is? How do you get money from child support if the father is in arrears $8500 he works and the money is being taking out of his wages but it goes back to welfare...how do i get some of that money for my kids..I called my local child support enforcement but i haven't got any info on how to recieve money for my kids. I'm in NY (Westchester County)

Your local child support office will have to set up a new orser stating what is the current support and what is the arrearage. The current support will come to you as you are not drawing assistance and the past due will go to the state until the entire state debt is paid off and then if anything is left you will recieve it as well but YOU have to contact them and get it done.

not exactly sure on that one, when i came off public assistance i began receive a partial child support check until the arrears were paid, the government is allowed to take part of the money to pay them back but you should receive something, you might want to go to somewhere like legal aid and see if they could help you

You need to take him back to court and have more money taken out of his checks. If he is only paying on the back child support he is still falling behind every month by your not getting the money.

I'm sorry but that's the way it works. The only way you will get any money is when welfare stops taking theirs back.
