You would have to show just cause for the children to be given to you--like abuse or neglect. This could get very messy in court but yes, you potentially could win. Go see a lawyer first thing.

Yes you can. It is very unhealthy for a child to experience that all of the time. You, of course, have the burden of proof. I suggest talking with a lawyer and Department of Family Services about this.

sure you can gain custody but you will need to get proof that there is violence in the home and that the child personally is in danger, it would also help if the child is old enough to stand in front of a judge and be willing to choose staying with you over the mother, good luck

yep take her azz to court, or at least threaten to. If the child is yours also, then you have every right to be worried for the very well being of that child. Go for it.
