As a customer service representative, is it illegal for me to ask someone to get off their cell phone while driving and to call me back when they are NOT driving? I've lost a few close relatives and friends in car accidents that involved someone talking on their cell phone while driving and NOT paying any attention to the road. I'm EXTREMELY against driving with cell phones. Please don't tell me to get over it. I'm merely asking if it is illegal to ask them to do this.

It is not illegal to ask. It is not illegal (yet) for them to dial and drive either. So don't be disappointed when they tell you to go to hell and serve them, the customer.
It may be against your companies policies. Check with your boss.

No, but you'll want to ask your boss about the policy on telling customers this. In many states, it is becoming illegal to drive while on the cell phone, anyway. Make sure you're doing it in a very polite and inoffensive way and clear it with your supervisor. Something like: Although we appreciate your concerns and wish to do the very best to provide you service, we will be unable to help you if you are driving while on the phone with us. This is a health hazard and we would not wish to see our customers injured. Is there a better time you can call us back? My direct line is ***-****

In some states it is illegal to talk on the cell phone while driving. I have not heard of any law that says you can't ask a person to call back later, but in your job, where people might spend several minutes on hold before talking to you, you could get complaints. You can always ask them to be careful or to pull over while talking.

Well there are currently no laws banning driving and using cell phones although it seems like they might be in the works. I don't think it is illegal but the customer might be offended, it would probably be better to ask your employer if they have a problem with you asking customers to call back. It seems as though someone might get huffy and complain about you to your employer.

I don't see why it would be illegal. You could possibly be saving someones life by asking them to do that.

Absolutely, this is a blatant violation of Civil Code 13544.244(ii)(c): "No customer service representative can ask a motorist to cease communicating on a cell phone."
