My wife got very ill 3 weeks later. I canceled on buying it. It was from a private party. No contract was signed only a check was given. They won't give my deposit back. Is the legal?

Trouble. Talk nice to them, try to offer them $100 for their trouble. or see you in small claims court. you can do it without a lawyer

The $500 deposit was a "promisory" note that you were going to buy. If you prevented someone else from buying, then yes, you've lost the money. Laws vary from state to state, so I'd contact an attorney in the state the RV was in and see what he says.

Yes...your deposit was to hold the RV so you could purchase it..he could have lost procpective buyers in the time he was holding it for you and then you cancelled on him so. Therefore the $500 was to make up for the procpective buyers he would of/might of had.

You did , after all, take the RV 'off the market' for 3 weeks.
The seller quit tryin to sell it because they had a deposit on it !
They probably could have sold it in the mean time but didn't because you were supposed to buy it.

Im pretty sure it is. I mean if you make a deposit or down payment on anything that means u have intentions on purchasing it. That money goes towards billing for that item so the seler is not authorized to give it back, unfortunately.

well duh!!! That is the whole idea of taking a deposit if you are the seller! They have lost 3 weeks of potential buyers since you promised to take it. If you are a decent person your word should be as good as a contract, Sorry your wife got sick but that is not their fault. that deposit is theirs not yours
