Can your employer/company refuse to insure your significant other because you are not married ?
My nephew started a new job and put his girlfriend on his insurance.The company just found out they were not married and told him he could not put her on his insurance and canceled her.
They are living together and have an 8 month old baby.

I concur with the earlier answers that say it is legal for the insurer to exclude his girlfriend and baby. In fact, since the group plan excludes them, they never were insured at all - that is, they were not covered until it was discovered that the couple was not married. If anything happened during that time, they are on their own.
Don't wait a minute. Tell your nephew to get coverage for his girlfriend and baby right away. It is very dangerous to have no health insurance. Short-term health insurance is really good coverage and it can go into effect immediately (no wait of 3 to 6 weeks for underwriting) and it is much less expensive. Most employers do not insure girlfriends/boyfriends.

Why don't they get married, and solve the problem?

Yes and it's legal too. Being married has some good things about it.
