What if there is a case, a staying ilegal girl having a baby with a man, non UK-passport holder (from commonwealth country member) but serving the British armed forced. Do you think the girl and baby could stay legally in the Britain?? As if its happend with a british guy then the girl could stay legally...

Very doubtful. For someone to be permitted to marry in the UK they must have at least 6 months remaining on their ELR. Illegals are not permitted to marry in the UK, only at Mosque and this isn't recognised as a registered marriage.
The Home Office will not entertain the fact that a child has been brought into the world as a reason to give somebody asylum, if the countries safe for you to return, they will insist on this. Having said this, on June 12 2006, they introduced a one off scheme to allow asylum seeking families who have been here since before October 2002 the right to apply for ILR, I don't know if you would fit into this though.

I mostly agree with Cate. And every people who are serving the British army forces, wich is not a british passport holder has ''An unlimitation of staying permit in Britain". I have seen that! As there are alots of them come from commonwealth countries member. And if He/She is married then wherever the partner come from is allow to stay in Britain unlimitation staying permit should be stamp on their recent passport. As well wherever He will be posting to another countries (as the bristish army has many camp in another countries, like belgium,holland,germany,ireland, scotland, etc) she is also will get the staying permit there.

In this case, the girl is staying ilegal and would have a baby from an army-a non bristish passport-holder, then i think she could have staying permit. Just like Cate said, he is then need to talk and find the info from the army family office how he could do things works out. And they 'could' do marriage by the military system. So You both just need those info from the family welfare there. And married soldier is always get a house and most of the main housing furniture are always provided by the army, ofcourse they all have to pay ...%...by cutting from their salary, i guess.

Just FIND IT OUT! as if that girl, woman, would have a baby from a british citizenship she COULD stay in Britain, even she is staying ilegal there!!!!

Note : In your case, the guy is a non british passport-holder, so you cant have the citizenship, only the staying permit as long as the guy serving the British army forces. But then in the future they could apply for a citizenship, have no idea how long it will take time.

Ex service member, you can only serve in the British Armed Forces if you have a British Passport for longer than (i think, don't quote me 8 years) . Non UK passport hoders are not allowed to join our army. So who ever has told you this is lying. Take care and Good Luck.

if he is a commonwealth country member serving in british armed forces then the girl (woman, i hope, if she is going to have his baby) should be allowed to stay. Furthermore if he speaks to his personnel officer in the army they may be able to have some army support. If they marry of course then she and baby are fine and can stay in britain and would be entitled to housing through the army. He can get more info on this..............unless he is unaware of this situation, as yet!

Your english is very broken but if you are having a relationship with a man who is serving in the British forces and you are expecting his child then make sure you get married,the courts should look on your case favourabley after all the man is serving his country

The only way they will be granted leave to remain is if the girl applies for a fiancee or spouse visa along with the British man... The baby adopts the nationality of the mother, although he has the birthright to live in the UK when he's older...

It wouldnt happen, because you cant serve in the British armed forces without a british passport (i believe)

Sounds like it could be difficult. i would say that the country that you would be expected to go to would be the mans country of origin, where ever that is.
