Except for 1 son my 4 girls are in fosterhomes,they said my moms home was to crowded for all the kids but the worker said if i gave legal guardianship to my mom, the rules dont apply.

She is blood, so yes you should be able to give her legal custody. Keep in mind this will have to be done through the court system and once done, you may not be able to reverse it.

It sounds like the state is willing to allow you to give guardianship of the children to your mother. Your mother probably cannot be licensed as a foster care provider because she does not have enough room. However, guardianship does not generally take those kinds of considerations into account.

I think the real issue is are you going to be able to maintain a healthy relationship with your mother under these circumstances. Also, is your mother really capable of handling your four children...that is a lot of work. Usually the guardianship will not be changed until you go back to court...this could potentially pit you and your mother against each other for who has control of the children. That can be hard.

With all that said, the foster care system is a difficult place for the children to be. If they were living with family, it may at least lessen the impact of all this stuff going on in their lives. I wish you well.

It depends on the state. Even if you want to, though, the guardianship of your children lies with the state, not you.
there is something called kinship fostercare, I use to be a kinship fosterparent, and I had to go through an approval process. The bottom line is that each child will need a bed, and there needs to be enough food for everyone. If your mom has a home that is not large enough, help her to get a bigger one.

That is true. Depending on your state there are legal proceedings to give permanent or temporary custody of children to a grandparent. Bear in mind however, that the foster homes receive funds for the care of each child who is covered by medicaid. In most states a family legal custodian does not receive these benefits.

Each case is different. It depends on the individual situation. You need to talk to your social worker and ask how you go about doing it.

it depends on your situation, but you can give legal guardianship of your kids to your mother
