i have no money or no help from anyone but myself.i owe them 1,0108.00 but i have no money until sept.

to sarah- its only 1000.00 , i never recieved a summons or any paperwork for that matter. and its the debt collectors cohen and slamowitz in nyc

Since you said you were never served, the first thing you should do is go to your district/county court clerks office and ask to see the case file. See if you "have" been sued. If you have not been sued - find a lawyer immediatly and sue their butts for every violation, even the ones on your credit reports + the hardship they put your through.

If a suit was filed, read what the process server has written about your summons service. Read it thoroughly to make sure the process server didn't fudge the service and either failed to serve you or left the summons at some other address. You should also ask for a complete copy of the full file. << This whole paragraph is very important. It could mean the difference between getting the suit vacated or not.

From what I've read about that company, they are pretty big on sewer service. Which could mean that they may have left your summons at some address that you never lived at or one that you had lived at years ago.

It's possible that you may be able to have the judgment vacated if they failed to serve you properly.

If they had served you properly, it may be possible that you can file a hardship with the court.

But, you definately would need a lawyers help with this.

You can try either Legal Aid or go to the NACA site I've listed and look for a lawyer in your area. I'd recommend NACA first before Legal Aid.
Legal Aid is good, but more than likely all they will do is help you write up the paperwork.

If the NACA lawyer says all you can do is file for hardship or vacate, you can probably use Legal Aid for help with the paperwork and you can handle the filings etc. But it the NACA lawyer says you have a case against these people, you will probably want something more than Legal Aid can give you. Plus the NACA lawyer may take it on contingency if there is a case.

Many lawyers will give a free first consult, just be sure to ask when you call to make an appointment. The lawyer will be able to tell you what options you will have. Be sure to take a copy of the case file and your credit reports with you when you speak to a lawyer. (I'm willing to bet that if they or the collection agency is listed on your reports, they probably have violations listed)

Do this as fast as you can as there are time limits on what you can do.

Unfortunately, I'm very sorry to say, this will probably take awhile to resolve. I don't know how long it will take, but I seriously doubt that it will be resolved soon.




It's also possible that you were out of the statute of limitations for collection. For New York it is 6 years from the time you went 30 days late and never brought the account current. IF they filed past that 6 year mark then they would have filed it past SOL. This fact doesn't do much good if they have a judgment though. But could be one more thing to hang them on if they have failed to properly serve you, you get the suit vacated and you decide to sue them for all of the violations they may have done.

Usually, your bank gives out 30 days for you to, at least, make a payment arrangement. since you won't be able to afford it till Sept, your case would have been sent to collection agency by then. OUCH!!! What you can do is to make your payment based on your agreement with your financial institution when you can, or file for Chapter 7 bankruptcy. That's going to really hurt your credit, though.

i think you call the credit card company and tell them your situation. then try to arrange some payment prgram with them
only thousand....
it is not too much money so i think they can do something for you i am sure they want the money...

what credit card company was it
who was the collection agency
were you presented a summons.

call a lawyer - if you owe them that much they have reason to freeze your account - try the legal aid society for help
