With a relatively simple case, is it out of the question to think that I can file bankruptcy with a kit?

possible, but not worth it
what if you make a mistake and the bankruptcy is thrown out? then you'd be back to where you started or worse
bankruptcy and divorce are 2 situations in life in which I'd advise anyone to get a lawyer....don't be cheap and risk it all

Yes. It is a very simple case of doing your homework prior to appearing in court. Go to your local library and research the bk codes in your state. Very simple. This is of course that your situation is as simple as implied.

You can, but you have to do all the homework. The BK laws changed last fall, and you'll need to research them to be sure you are right.

There are 2 BK's for individuals Chapter 13 and Chapter 7. Bk 7 now forces you to go to credit counseling for 6 mos. before you can file. BK 13 means you pay the arrearage for 60 mos. plus normal payments on your SECURED debt. Then you get your discharge. That means you don't owe the unsecured creditors anything else, and they can't call you or bill you. But you still owe the secured folks. That's business as usual.

I would consult a trustee in bankruptcy. You don't need a lawyer.
