I got behind on my car payment to Triad bank and they accepted that I would catch up on the 1st of the month. I still get calls from collectors twice a day or more telling me I have to pay it earlier. They tell me that "the system doesn't recognise a verbal agreement" and that they "autodialer can't be turned off". My god, I made a deal, they accepted it and they still harass me constantly. Today the guy told me I absolutely had to pay it two days earlier than our deal was set for. Can they legally harrass me like that? I'm guessing they can or they wouldn't be doing it it...

ask for a supervisor. the agreement can be put into the system and they "should" not call you until it is broken. The deal of the 2 days early is becasue they want the end of the month numbers to look better.

As a "repo guy," not a phone "collector" I can say that they can contact you anywhere during the hours of 7:00 a.m. and 9:00 p.m. with the very noticeable exception of your place of employment. With the very first call at your pob, if you request no more calls the lender, or 2nd or 3rd party collector must comply or be in violation of federal collection laws.
As for any verbal agreement, well, they really don't exist.
As for the "guy" telling you you had to pay it two days earlier, he can say that within the law. Whether or not it is ethical to those that are not in the "know" is up for question. I feel that it is not..Keep in mind that phone collectors in many cases are persons that are rude, mean and don't have the courage to face a debtor face to face and resolve a situation, ie:debt.

Do everything in writing, including tomorrow morning, write the Federal Trade Commission about unfair debt colletction practices. Also telephone your closest branch and complain verbally ! Just simply say, these are the terms upon which I agreed to pay and I wish to hear no more by phone about it. Put everything in writing ! Do not telephone me order is a request the FTC will help you enforce. Say that the calls come at odd times and disrupt your family's life. BUT... watch out for repo, keep the car down the street somewhere, take the plates off it, block it in, put it in a neighbor's garage. What they are doing is NOT LEGAL you have just not gotten tough enough with them, cal the FTC and fill out whatever forms they send you, and bring up their name every time the lender calls you, and back them down, tell them never to telephone again or give them a very narrow time frame. It may take a month, but when bank gets the call, they will immediately change ! The car is yours, they are trying to steal it !

the fmr manager is right, collections departments are very focused on the last day of the month

that being said, I'd start hanging up if they kept calling; harassment isn't legal, period; you might want to consider filing a complaint with whoever licenses collection agencies in your state
