i was in a domestic dispute with my daughter, the juvinile court awarded her to foster care, my drug use was brought up, and i am seeking treatment. however, the policd have come to my door and said if im not in treatment in two days, im going to jail. there has been no court order, i have not disputed custody for my child, so at this point, wouldnt it be volintery for me to go to treatment or not? can the police just come to my door and harasse me like that?

First of all, even if you are not attempting to regain custody of your daughter the reasoning for drug testing is a sound decision. All they want you to do is give them some measurable, documented information about your "addiction" status. Try to keep the perspective that they are realling trying to do the right thing for your CHILD.
Your participation, however, is probably NOT voluntary. Generally it is a condition ordered by the family court judge that MUST be complied with. Another example of mandatory participation might be "anger management" classes. The purpose is not so much as to hurt you, but to insure your daughter's safety.
However, if you do not comply you may be arrested for a variety of different charges.
1. Violation/Disobey a Court Order
2. Contempt of Court
3. Drug Violation (if on undesignated felony status)
4. Probation Violation (if currently on probation)
Bottom line - - - jump through the hoops, give in to the courts, It's obvious to me that you want to keep your daughter in your life; so it will all be worth it.
Good luck.

If the court did not tell you you had to go into drug rehab or take part in a treatment program of some kind....I can't understand why they came after you. I'd ask the judge to explain. If they had no reason to pick you up.....they are in trouble.

Yes. The police are actually doing you a favor by not busting your *** immediately. The deal is they look the other way temporarily to give you a chance to go to treatment. If you don't cooperate, they have no reason to let you slide.
Drug use is illegal.
If you aren't a parent trying to get your act together, then you are a crim. Don't be surprised if you are treated like one.

^^^^^^^^----Panacea----Drug USE is not illegal. What is illegal is being in posession of controlled substances. So if the cops come to your house, and you are high as f***, they can't do s***, unless you have more drugs in the house. And you know they will look. So make sure you use them all before they show up. As for your question, there must be a court order forcing you to go to rehab. If you don't go, then you can be arrested. If there is no court order, then you don't have to do anything you don't want to.

Wouldn't it be in your and your daughter's best interest if you just went without a court order or police harassment? I hope you decide to get help! Good luck.

I don't know if I would call that harrassment or just good advice. You already admitted you need help. You said you are seeking treatment. Seems to me they are trying to nudge you along a little bit.
