For those outside of Texas:

TABC = Texas Alcholic Beverage Commission. They pulled some asinine crap where they went to bars to find people drunk and arrest them for being intoxicated in public.

You do not EVER have to give a breathalyzer test. However, in certain circumstances, there are consequences, for instance if you were driving when they asked you to. You still don't have to give it, but your license will automatically be suspended for a period of time.

There is a possibilty that mere ownership of a license entitles law enforcement to do this at anytime and any place with the same repricussions.

I don't know who TABC is. I know if you are pulled over for DUI and refuse the Breathalyzer, some states automatically suspend your drivers license. If you are still in the bar, it would be hard to prove you had any intention of driving. Even if your car is parked outside, you could still call a cab.

what is TABC? I dont know what that is, but I know if you refuse to blow into a breathalyzer for a police officer and they have a reason to take you to jail, they will take you to the hospital for a blood draw. no way around it buddy

I think you mean ATFB, which is the Alcohol, Tobacco and Firearms Bureau. I have never heard of them going to a bar and doing that, or police, either. If I was in a bar and they tried to make me take a breathalizer test, I would refuse, because I think since I am on private property, with no probable cause for them to give me a test, it would be illegal. However, if the bar owner called them because I was causing a disturbance, I would have to submit and then be arrested for either drunk in public or under the influence if I was over the legal limit. I think it is illegal for any law enforcement agency to enter a bar and try to conduct random tests, and I've never heard of such a thing.

Are the TABC still doing that bullsh!t arresting people for being intoxicated while in a bar? Damnit, I'm pissing on their shoes next time they pull that.. :\

If you are a minor, your busted. They must have a reason to Breathalyze you. If you are driving you must submit to a breathalyzer or a blood test. If you piss them off, you can get arrested for being intoxicated in public. But, you cant get arrested for refusing.

i thoguht i read an aritcle saying the tabc stopped doing that, because they were under so much criticism. they were claiming that people were gonna drive drunk or something, but i dont know how they could tell that inside the bar.

Who is TABC? Yes you can refuse, but you will get arrested anyways... for refusing.

You can refuse at any time. That refusal, if followed by a conviction, can lead to even more difficulty for you. I don't believe they are doing the in bar testing anymore, except for establishments that have been under investigation for serving minors. If amyone knows differently, please respond.
