Service dogs and the ADA.ETC......

the city police seems not to understand the laws for the ADA(federal Laws).Concerning the use of service dogs in public.They say that only dogs for the blind and deaf are allowed in public places and other types of service dogs are not allowed. So how do I approach this issue correctly.

Try printing off this law youre talking about and taking that to the police department where you live. Talk to the chief or one of the Captains maybe and explain what youre talking about...
You wont be arrested, this is not Nazi Germany...
Just dont do it with attitude...

If you're not a Federal Officer invoking a Jurisdictional issue, yes. It is illegal for anyone to argue, defame, give a hard time to or otherwise resist, verbally or phsyically, any action from a sworne office of the law who is in uniform, fully identified by badge and ID who is stopping you for reasonable cause, has jurdiscition over the area and matter at hand.

It's called interferring with a police officer or resisting arrest.

If you are a sworn Federal officer then you need to ID yourself, state your jurdiscitional issues and ask to have the Officer's supervisor on scene.

Boy you better be right or your boss will come down on you when the Chief of Police calls up to complain!

Maybe you can carry the section on service dogs.. and how do you employ your service dog? But if your talking about private property the owner can probably bar you as an individual from his premise. Up to you to prove he violated some rule in a civil court/suit. If the owner of private property calls police on you, and you refuse to leave you and the dog will probably be arrested.

You can explain federal laws until you're blue in the face, but they don't mean squat if the state or municipal law overrides it.
For example, federal law AND the constitution allow me to keep and bear arms, but state and municipal laws say I can't carry it to certain areas or in certain situations, than that is the law that I must follow.

Nobody likes a smartass. If they say move, please move. Save the Boston legal speaches for the court room, not the street. If your are in need of a guide dog, it should be rather obvious. Just say, "Hey, I'm (insert problem) this is my guide dog "Spot." That should handle 80% of issues.

I am sure they will be quite happy to listen patiently to you as you "explain" federal law, course if they are talking to you concerning STATE law, well good luck to ya

If you are just talking in general, then I dont see how they could.

Of course if they follow the simple "arrest em all and let the JUDGE decide who to keep..................." again good luck

Time and place for everything. A patrol cop handling a situation is not going to listen to you spouting off. When appropriate, your lawyer can make these points.

Yup they call it "obstruct police" or depending on the mood of the officer... many other possible police act codes.. like loitering..etc.
