In most states it will be punishable as capital murder or capital homicide.
I believe it should be a higher charge because not only did the person intend on killing another human, but they also disrespected authority. There are two levels of evil there, one for killing a person and another for disrespecting legitimate authority.
Just my opinion

Possibly and here is the reason why: the police have the job to keep society in general under control. Now that is not a bad thing. They are there to protect those of us who choose to respect the rights of others and want to in turn have our rights respected. When someone crosses the line, the police have society's role of resolving the conflict and beginning the process to punish the violators of society. Without police, we would have to all be armed and have to totally protect ourselves and exact and inflict punishment upon others. it would be violent and disorderly to say the least. Police therefor are symbols of the society and its order. Attacking police is attacking the society at large, meaning attacking all of us. When police show up somewhere, it is often the moment when the conflict is going to end. They are peacekeepers. People who continually break the law and attack police are the worst sorts of people there are. They disrupt the flow of our society. That is why we put them in jail. They are in a very real sense local terrorists. So for those who go beyond attacking individual citizens and attack police (as stated before, therefor attacking all of society in general), their punishment needs to be harsher.

First let me say I have nothing but respect for our police men and women. They put their lives on the line every day. That said, I believe all crimes should be punished the same way. There is no need to pass a hate crime bill, or a terrorist crime bill. Punish all with the same level of sentencing. I am opposed to capital punishment. I don't think it does anything to deter a crime. Keep in mind, criminals never think they are going to get caught. So the chance of a death sentance will not deter them.

I think killing any cop, on or off duty should carry a minimum of life in prison without parole and at the max the death penalty.

interior the subject you basically published, it would be decrease than the criminal homicide rule. extremely, while you're comitting a unfavourable criminal and somebody dies...all people...you're in command of homicide. the reality that the sufferer is a cop could be an enhancement. Secondly, the reality which you went to get your gun and the guy escapes ability that in case you chased him, you at the instant are not from now on interior the warmth of the 2d. fairly if he's so a techniques away which you had to shoot down the line. Premeditation doesnt propose you're able to desire to devise it out over an prolonged quantity of time. it may ensue in a chop up 2d. in this occasion, as quickly because of the fact the guy escaped, there is little or no justification. yet regardless of if there have been justification to knock it right down to Manslaughter (or tried manslaughter) the criminal homicide rule might nevertheless advance the killing of the cop to homicide a million. you're taking your sufferer as you hit upon him. there is not any such subject as an twist of fate once you purposely fire a weapon at somebody. you plan something that happens. Carl's answer is right in that because of the fact the cop grew to become into in uniform it would continuously be homicide a million. in spite of the shown fact that, law enforcement officials who're not in uniform and who're interior the zone of risk because of the fact they are responding might additionally advance the crime. remember, the shooter grew to become into shooting at all people down there. Now if the shooter got here residing house and located his spouse in mattress with a bare guy who occurred to be a cop and he snapped and shot them the two in mattress, THAT probable does not be homicide one. in simple terms 2 counts of Man1. As for mense rea, sure it quite is present day. as quickly as the guy escaped the residing house, the shooting grew to become into tried homicide, not manslaughter. The mense rea existed whilst he pulled the set off. The criminal homicide rule does not require particular purpose to hit that guy or woman. in simple terms the particular purpose to kill somebody. **Scott, precisely properly suited. shooting on the guy after going to the storage after the guy left the residing house could be attempt homicide and homicide a million.
