The law that covers this is the Equal Opportunity Credit Act and it is designed to ensure that you can have a separate credit profile. Actually you can use it now. Take a look on your credit report and separate out everything that is yours from your husband. Write the credit bureaus and after you research the Equal Opportuinty Credit Act you have your ammunition to change your report. If you have something joint then instead of closing the account (that can kill your credit score) instead have your divorce attorney negotiate that one of you will keep the account and then get the current creditor to agree to carry it in one person's name also.
