I have a bigger problem...kids spit on the floor in high skool & on the railings it's so disguisting especially since its not cement & takes so long to go away

Some places do have that law. I'm pretty certain (unless it's been changed) that NYC has that law.
But sometimes spitting is just inevitable. Like a nasty taste in your mouth.

I think people shouldn't spit out their gum on sidewalks. But if it's just spit--i think it's fine. It's not like people are going to lick the ground! And stepping on someone's spit isn't nearly as bad as second-hand smoke--it can't kill you!

It is also illegal in Dodge City, Kansas.
In Saint Marys, Georgia, you cannot spit on the sidewalk after dark (daytime hocking is OK for some reason).

It is against the law in some places. It's just not enforced. Check back in history and you'll find laws, like not riding your donkey drunk on Sundays - Leadville Co, that are still on the books, but not enforced.
