i sleep asleep at the wheel and hit a road sign i stop and flaged down a cop and he told me i smelled like i had been drinkin i told ya last night bout 8 hours ago so we did the feild subriey test and i passed and was going to let me go then another cop pulled up wanted breathalize me so i failed it then they read me my right and told me i didn't have to take the the test so if that is so i would not have taken it so does that mean that they are wrong and i have a case or am i going to JAil. help if u can!

If you refuse the brethalizer that's an automatic 1 year licence suspension. If this is your first dui then you'll only lose your licence for 6 mo. You will probably get 1 yr. probation and a court ordered drug/ alcohol evaluation. They tell most people they have to attend IOP (intensive out-patient program) which is usally 4 days a week for 3 hrs a day for around 6 mo. I've had two in Indiana (one in Bartholomew and one in Hamilton co) some counties are harder than others.
I wouldn't try to beat it. It doesn't sound like you have a case. Just take a court appointed lawyer if you can and take the plea agreement. It's a pretty standard sentence for your first one whether you have a good lawyer or not.

In the state of Georgia, if you drink just one beer, you are conceidred drunk. This is a no tolalance state. In Georgia you will get 30 days in jail, 200 hours of community service, have to attened driving school, $1000 fine and you can't drive for 90 days. That taught me a good lesson, hope you have better luck.

Get the right shyster lawyer who can pay off the judge you can get the charge reduced to reckless driving. The system sees you as easy revenue ($$$) and it is going to cost you both money and stress. I don't drink at all, never did but I feel this whole DUI program is just one more government rip off. DUI is way over blow but the dumb voters(sheep) are duped into believing they are being protected by the wolves they have elected. I feel sorry for you as you could be in for at least 1 year of hell from the system.

Matts right I got a OVI refused the breathalizer One year suspension automatic.Get a PD don't waste money tryin to fight it a lawyer will cost around 750. fine up to 500. one year on probation M.A.D.D. meetings suspention busted down to 6 months..Don't Drink and drivr and sober up before you try asking questions in here...

If you had refused to take the breatalizer, they would have hauled you in anyway, and still cited you.
If you had been drinking 8 hours previously, and none in the 8 hours right before you tooik it, nothing would have registered.
Get a lawyer, its your best bet.
And please, learn your lesson .... dont drink and drive.
