Anyone know if it is against the law for your ex-wife to forge her name on a Tax Return while your going through a separation before a divorce when you are away in another state. I was told by the IRS it was tax fraud on someone else writing their name on the Tax Form. Could this be true if the IRS said this.

Thanks

Your wife is in BIG *** trouble if she put her name on a return that you did not file with her. You are either still legally married in which case you can file a joint return and you BOTH have to know each other is signining! OR you are separarated and you are filing "married filing separately", then you are each filing your own returns. She cannot put her name on your return - nor you on hers. The same is true if you are "single" for tax purposes. You must each file your own return. You will have to give more details so we can give you a better answer, but you are better off to go to your local tax office and speak to a tax preparer about all the details.

Additional response:

It sure as hell IS illegal! She's going to be stuck with a big *** fine and/or possibly jail!

It's very much illegal for her to forge YOUR name on the returrn.

It's quite legal for her to put her OWN name on it. In fact, it's a requirement. One cannot forge their own name!

so your ex wife forged her own name???? I don't get it...either way whatever the IRS says is written in stone.

Forging is always illegal.

If you can get a copy of the return and prove it is not your signature, she is in trouble.

But it will be a hassel as dealing with the governemnt is NEVER easy.

Good luck!
