He gave me some money while we were dating. I tried to pay him back, but he would not take the money. Now he is taking me to court. We never discussed any payment arrangements and he would not take any money from me while we were dating. I have to go to court.... what should I do.. Does he have a valid lawsuit... He only gave me $1,000.00.

My point is when I tried to give him some money back... he said "don't worry about it" it was only after we had broken up.. and not spoken in months that he is trying to get it back.. We never spoke of it as a loan. He said he just wanted to help me out.

So it's gotten so far that you have a court date. Did you sign anything. I'm not a lawyer, but I don't think he has a basis on which to prevail. It will be he says, she says and a matter of credibility. Do either of you have a witness who heard the discussions about the loan. Yes, he gave you the money and then tell your honest version of what happened.

Did you sign a promissory note, a contract or in any way make any payment arrangement?

The only place he has a case (unless you answered yes to the above) is that you tried to pay him back once. This implies you knew it was a loan and not a gift.

Well, if you offered to pay it back then, why not just pay it back now? Regardless if you discussed payment arrangements or not, the very fact that you were trying to give him the money points to it being a loan.

Haha you americans sue over anything so silly, Yeah you'll have to pay. So silly tho why cant ppl just let things go? Good luck. Think back did you loan him any cash or buy him anything big. ?Say something like that in court and judge will just throw it out call it even.

If what you say is true, Then I think what he is doing is just another form of stalking. And a cowardly one at that. Not that there is a good form of stalking.
I doubt he has an chance in a law suit. It's your word against his. He's just harassing you to try and get you upset and miserable like he probably is. You know, misery loves company. If it escalates in any way I would seriously talk to someone because it can get dangerous.

I suggest moving this to a different section or reposting. Maybe in divorce, because there might be laywers and stuff. Also, the law depends on what country/state you live in.
