My husband is illegal and we have a child together, but it is hard doing everything. he has the job and makes money while i take care of the baby. we want to get a house and other things but without a ss# or greencard or visa it is impossible. so how do i help him become legal so that we can be a happier family?

it use to be that once an illegal married an us-citiz. that they could become legal but now its different. i dont want him to have to go back to mexico and try to enter there because we have a 11month old and he will never be able to see his child, and what if they wont let him come back.

I was an illegal immigrant, while my hubby is a natural born citizen. I had the same problem! Let me walk you through it. First off, what you must do is go to www.uscis.gov. All the needed forms, advice, phone numbers, addresses can be obtained and downloaded online. It's extremely convenient. You download the residency form, fill it out, make copies of the necessary documents, get a money order to pay the fees and all will be done rather quickly. You can also ask for a work permit and a social security number. Becoming a resident won't take you very long.

After three years of having been a resident, your husband may apply for citizenship (long as he has learned to read, write and speak reasonably good English). Again, go online, download the N-400 form (for citizenship), pay the fees with a money order, get fingerprinted, take the test and go to the meeting; immediately after taking the test they tell you whether you've passed or not. Soon after (about a month) you'll get a letter in the mail, telling you where to go for the citizenship ceremony.

After that, you're a naturalized citizen and free to live, work and play here!

It will take any where from about 1 1/2 to 2 years to get him legal. What is really important is for you or him to get his boss where he has been working at to back him up by saying that your husband is very important to his company and that he has always been responsible etc. and see if his boss will more or less say he will sponser him since you are not working you have no way of proving that you make 125% over the poverty line which is a requirement for getting his papers. You will be able to get him legal dont worry but you want to be able to keep him at home and working and not have to have him be deported while he waits. My friend is going thru all that mess right now and after 2 years and her husband being over in Mexico after getting deported for being illegal they are finally going to Juarez to finish the deal. You need an immigration lawyer. If you want to find out all the info just go to the INS website. You will find everything you need to know there.

if your I 94 is expired find a lawyer who will take your case because most of the lawyer here in america doesnt accept illegals whose I 94 is expired, then find a willing employer.

Well if he is your husband then you can apply for his citizenship after being married for two years or so. He can also apply for a work visa anytime.

go back to mexico and do it right. you said that you were also married he should be able to become a legal resident since your american citizen right.

get him a visa,,,proof of birth, (certificate) ask the ins they may be able to help you
