I am 22y/o I have been in the USA 5 years I came here with a turist Visa, My fathe has been a permanent resident for the last 38 years my mother is citizen. my father sent the petition 5 years ago, but i have not received anything. What if i send another request through my mother? how many years does it take if she is citizen?

no my Visa has not expired yet, It was for 10 years. so I have 5 years more.

The petition can be valid even if you are illegal. Those are two completely different things - although you had better go home now because an illegal overstay can make you inadmissible, meaning that even if you're entitled to a visa, you can't have one to go to the US.

If you are still unmarried, you are an F2:

Never gonna happen. I'm pretty sure that your tourist visa has expired which makes you illegal. The petition is pretty much dead in the water.

Depending on country on origin since you were petitioned before 21 it takes about 10 - 15 years.

Also if your dad has been a perm resident for 38 yrs why didn't he get citizenship already?
