INTENT INTENT INTENT. and usually you are not arrested unless you like, have a weapon and are threatening to use it against them. If you walk by and say "im going to kill you" and someoen reports that, in MOST cases... *MOST* the officers will not do anything about that. If you have a knife or a gun and walk by and say the same thing, then you will be arrested for the threat. make sense?

The steps of intent have to be met before an arrest can be made on communicating a threat.
A. Does the person have the means to carry out such threat?
B. Distance
C. Mode
D. Person recieving threat feel threat is real

It may vary in your state,but this is just a basic definition.

If a person feels that the threat has the possibility of being acted upon, you can be arrested for that.

Perception is a major biitch.

If someone has been threatened, generally the police won't consider it a big deal cuz they have their hands quite full. I'm not being sarcastic. I'm being factual.
What the cops will do is have the one who was threatened fill out a police report. Then if something happens, the idiot who threatened the person goes away.

When you threat someone with bodily harm or injury.

Like "Im going to Fkn Kill YOU!"

a threat(assault) is when you say your going to hit them. battery is when you do it. so, this is where we get " Assault & Battery"
