Now the wife is back in her country (The wife entered the US using tourist visa) and the husband wants to bring her back to live in Ohio with him permanently.What is the legal procedure so she can stay in states?To whom can they talk to?

browneyedgirl,thanks for your clarification.I understand it was a little bit odd that the husband let the wife went back to her country.But the wife has job obligation therefore she can't just leave everything and had to go back(for a while).That is why i am asking for advices as both of them wants to do this the right way.They have known each other for about 3 years (although never met) and when the wife went to visit a relative in the US,the husband decided to meet her.They are so much in love that they got married in the spur of the moment.The wife will be back in states in a month's time & that is why they want to know the procedure on what to do.

Tell to the husband to contact an immigration lawyer from his city, this lawyer will tell him what forms are needed to be filled as well of haw much will cost. if the forms are filled out by the lawyer will cost more, some of the forms the he need to process from Homeland Security like I-130 Petition for Alien Relative,G-325a, I-131, I-485,I-765, they need tio be filled out (you can do it they are not that difficult), you can find then in the Internet and printed then and filled then by hand (that's not a problem) one form per each person, as well of all the personal documentation (birth certificate-translated if it is not in English, etc), well all that will be requested by the lawyer.

The US Embassy in Malaysia is one place to start or a lawyer here. If you choose the Embassy route, she must ask for an appointment to get an Immigrant Visa (IV) and get approved for a Green Card. The procedure takes months, months to get the appointment, and months to get approved for a Green Card. You see, at the appointment, she must show that this marriage is legitimate and was not done for the sole purpose of getting immigrant status. You seem to have a battle ahead of you. She was just here as a tourist and you got married? And then you let her go, when you could have done the procedures here? Both of you should have contacted the Immigration and Naturalization Services while she was here. What kind of a marriage is this? Can't you at least go spend time with her or meet somewhere else for some time? I'm just showing you the kind of doubts the US will have about this marriage. If you can afford it, hire an Immigration lawyer here. He/She will handle all ends. My sister lived with her B/F two years in the states and married in the States and it was still a bit difficult for him. The US wants to make sure the people know each other intimately and love each other and that is the only reason why they got married.

Best thing to do is contact the American Embassy they have all the information he would need ,,Its not impossible to stay together in another country from your own but has to be done legally ,Any information given here would be a waste of time because there are allot of situations to be addressed and the proper authorities would give you all the correct answers ,

marrying it will NOT give you instant US Citizenship there are procedures in place start with an i 130 after its granted the foreign mate enters the USA, green card issued, permanent residency is astablished, and your wife will never have to leave you again why din't you file this pettion right after marriage????

If a foreign woman marries American man, she instantly becomes American Citizen. it's stupid but woman who wants to become American will pay some bucks to a man and he will marry her. Even after divorce (which happens very fast in such situation) she remains American.
