is there a lawer in the house that can help my son hes been charged with haveing sex with a minor but she had told him she was older then what she was we had a lawer an he quite now my son is setting in boone county ar jail with out a lawer he had a public defender but belive me they stink an we hired a lawer an now he quite because he got mad at me an the public defender told him if he had to take the case over again he would make it harder on him then the prsocuter would so he afried to use him an with out a good lawer he dosent stand a chance an now we dont have no more money to pay a lawer an my husben is disabledcan some one help us please cherokee

Unfortunately, not knowing the age of the minor is not a defense to the charge.

Perhaps you should contact the prosecutor to see what kind of punishment is in line for your son and make a decision based on that.

Not knowing all of the situation I really hate even answering this question because I don't know who is telling the truth...your son or the girl. You didn't give much detail about the situation except that she lied about her age. What was the age difference? How old is your son? How old is the girl?

But I will tell you this..........your son has the right to ask for a different public defender for his case. He can ask for a different one especially if the first one is bias in his opinions.
In the mean time if I were YOU, I would be trying to find some character references for my son and also try finding out anything I could about the girl. Like has she done this kind of thing before with different men. Anyone that knows that she lies about her age for any reason. Things like that.

Boone County sounds like West Virginia if that is correct contact Robert E. Holroyd in Princeton his office number is 304-425-2103 maybe he could help you, if the girl will admit to lying about her age you may have a leg to stand on, witnesses, did they date for any length of time? Have you tried legal aid or Apple Red? If he acts decently the judge may just give him probation but I really don't know, with out more detail there isn't much I can tell you. If he's like 35 and shes 15 or 16 that may be a big problem.

You certainly have to feel sorry for this woman and her dilemma, but the fact is this is another example of uneducated America.
This generation is unschooled and without any communication skills because school consisted of cutting classes, drugs, parties and unprotected sex.

Now she has a son who will grow up as a rapist and sexual offender and will probably have to register wherever he lives or moves to in the country...so, his life is already ruined.

I hope she finds some proper legal advice and counsel that will get her and her son out of this mess but, first the son will be facing the rath of the community and the court system and will end up severly punished for his foolishness in not investigating whether he was having sex with a minor or not.
Just what are these kids thinking?

The best thing at this point to do is have another public defender assigned to your sons case. Then discuss a plea with him. It might not be ideal but it could be the difference between prison and community service. Unfortunately depending upon where you live laws are getting tougher for these crimes - regardless of the reasons. Your best option is the truth and a plea - talk with another public defender - they might not be what you consider the best but there are some out there that are very dedicated to their jobs. You have the right to choose one!

I´m really sorry. I know how hard situation you are living right now. I really wish I could help you, but I can´t and coz noone´s writen anything I just wanted at least to wish you good luck and to tell you to be patient, let´s see if soon someone answers with something good.

You better co operate if you get into court and have no attorney you need to let the Judge know what happened. BEHAVE! in front of the judge.
You will have to get a public defender and listen to them if you cant afford one.
Sometimes the prosecuting DA will make a " deal " with your attorney . Like probation etc.
It also depends on the age of your son and the minor, etc.

first of all iam no lawyer but how old was this other broad your son screweed?it dosent materr if she lied about her age or not the law says she was a minor at time of, the sex acts etc, and thats her word against your sonn he committed the act on her, was he chargedd with raping her too??and what kind of lawyer do you have anyways for a publiic defenderr while your son was committed too jail was this his first offense here or did they throw rape chargess against him which is a felony etc, if it wasent a rape charge if this was his first offense, then why is he in jaill etc, its got too be, he was arrested before or has a criminal record behind him here not the first time for hmm?/ owe my what was his bail set at , did they ask for, a property bond, bail meaning if you own anything they would put 30 percent towards realstate on the bail if he skips you forefitt everything you own here, i dont understand what hes doing in jail if this is his first offense makes no godam sense here, you are getting railroadeed, here, did he confess too having sex with her huge mistake if he did or plead guilty, normaslly under any good judge he would let him out on basil and put a restaring order against the broad you are in a mes here, good luck really pays too have ex dont it right etc/

Cherokee, sorry for your trouble but noone here could help you as you must deal with this locally. It's the girl's word against your son's and unless she drops the case, only the court can decide.

i know your a mom and you feel you have to help your son, but if he is sitting in jail that means he did something wrong. even if she lied, he should have kept his di** where it belongs, in his pants. my brother just went through something incredibly similar. he is 19 and she is 17 and they have a 7 month old daughter . she dropped out of school, he is unemployed and just got out of jail. they are married now. plenty of problems and strees and headaches. just be glad that she isn't pregnant and he won't be in jail for a long time. save your money for his education when he gets out of jail.
good luck, and let him learn the hard way. its not hurting him being in jail. he will survive, the son will rise, and life will go on.
