It should not. Jesus's one commandment that covers the rest: Love one another as I have loved you. Any accounts of Jesus having killed someone for being a sinner? He saved a woman accused of being a prostitute from being stoned to death (i.e., did not support the death penalty). And here's the real irony of it: Jesus HIMSELF was given the "death" penalty. He may have willingly died, but his whole presence on the earth was for the sake of teaching LOVE not punishment.

People will always preach and eye for an eye. but that was a specific period that the Israelites when through with God. That time has passed. Jesus showed us a new way. In God divine way, an eye for an eye is a spiritually unsound argument that only produces damage not healing. It does not bring back the person they killed, it only allows the offender to join its victim. Taking it away from the bible, the death penalty produces something called the brutalization affect which means after the process crime rates rise in terms of murder. Offenders kill their victims as a way to escape identification after the fact. Moreover, it costs millions of dollars to kill an individual rather than to house them alive. It does not work in the secular realm, nor does it, more importantly, in the spiritual.

That dude Jesus said I have not come to change the law but to fulfill it. So the OT laws are kinda still in effect.
Relegion really shouldnt be included on any point of law, that is like Un Constitutional. But if Guv is allowed to look at any correspondence and look up any skirt they want without cause, suspicion or warrant by the court, I guess any law Guv wants, Guv gets.
Speak Islam, death penalty, but a bit of torture first.
Talk funny, Torture followed by a little death.
Suspicious activities? Tortue,death,torture.
Plans of suspicious activities, Death,death,torture,death
Plans of plans that are of a suspicious nature, torture, death, tortue, death, death, death.

You're right, we should just abort all the innocent people (fetuses) who didn't commit a crime, because we think they would commit a crime because they grew up poor because their mom was a teenager who was raped. All girls who get pregnant are raped...right? And all criminals who repeat crimes over and over and more heinously each time should be allowed to live on our tax dollars. Yeah, whatever your the smartest one of the bunch yet.

The Law is not done away with.
Christ said "I did not come to change one Iota of the Law"
A murder can not find salvation in his soul (means in the flesh).
Must be put to death

IMHO, it should not.

"let he who is without sin, cast the first stone"

also

"You have heard that it was said, 'An eye for an eye and a tooth for a tooth.' But I say to you, Do not resist one who is evil. But if any one strikes you on the right cheek, turn to him the other also; and if any one would sue you and take your coat, let him have your cloak as well; and if any one forces you to go one mile, go with him two miles"

also

"But I tell you who hear me: Love your enemies, do good to those who hate you, bless those who curse you, pray for those who mistreat you. If someone strikes you on one cheek, turn to him the other also. "

Why does everybody ask religious questions on here? This should be a place of facts. Not peoples beliefs.

It's not a matter of 'should' it be legal but one of cause and effect, a social penalty to persuade people not to commit hard crime.
