The first step "should have" been to report it to the manager right away at the time it happened. Second step (which you didn't ask for) would be to go to the Dr and get checked for an injury. If it was not a serious injury, forget it. Did your mother have a witness to the fall? Most important if she did not report it at the time.

If your mother did all of the above at the time of the fall & has a witness, she could seek legal counsel. You might want to look in the yellow pages for a lawyer that deals in "injury" and call a few. They will tell you over the phone if she has a case or not. If it was not a serious injury, they would probably not even consider it to begin with. Even if it made it to court, the judge could throw it out as frivalous.

Most people miss the first step... report it immediately to the store manager, and if you are injured, go to the hospital. If she didn't do that, she has no case. Also, if the wet floor was clearly marked, she has no case - you will likely need photographic evidence of this, or a few witnesses. People hurt themselves like this all the time, and slipping on the floor makes you feel like a total ***... the natural American reaction to that is to ask "Who do I sue?", when most likely it's totally your own fault. Most slip-and-fall cases don't make it past a preliminary hearing. Call one of those Accident/Injury lawyers from late-night TV, and ask them about it... they will tell you if you have a case or not. They don't get paid if they don't win money, so they won't take a case that's a clear loser, and they will give you the reason why.

First I hope she informed the management that she fell in their store. Then she should go to her doctor or ER, get a report and a police report.

Usually a store will pay the bills for someone who got hurt on their property.

If you want to sue you will have to have put in a complaint to the manager of the store. If one was not put in while this happened, forget about any money compensation.Unless you can get the tape from security video, but may be erased by now. Always bring a camera with you.

Go to the ER. They will take xrays and make sure nothing is broken. Then, file a police report, and the restaurant will pick up the bill.

Find the manager and report the incident immediately. Then go to the ER. She can sue if she had actual damages.
