There is no explicit law that says playing poker online in the US is illegal. The government uses the 1961 Wire Act to prosecute people accepting bets on sports over the phone line. Some officials in the US government say that this can also apply to online poker, but to this date, I have not heard one person being charged with playing online poker. Some legal analysts say that the Wire act would never apply to online poker. This is the grey area.
The House recently passed a bill that would stop financial institutions from accepting online gambling money, but it still is yet to pass the Senate. If it passes the Senate, I would be a little more cautious about playing online poker.
There are some states that specifically outlaw online gambling but that you would have to check with your state. I believe Utah and Nevada, but I'm not sure.

The poker sites are all off shore. The US government is trying to crack down on the sites without any luck.
It is pointless. They can't and shouldn't ban you from playing a game that is mostly skill. Do you really think they could stop people from playing poker? With all the hype about the WSOP and WPT ....not a chance.

In theory, playing online poker for money in the United States is illegal period. So this doesnt change if you are playing on a US or non-US poker site, but nobody really cares much.

Actually, it is not illegal to play online poker in the US, it is illegal to transfer funds for gambling over phone lines (except for horse racing, which is strangely exempt). This is known as the wire act.
The legislation in Congress would make it illegal to use credit or debit cards to make these transactions online.
Nothing is addressing the legality of on-line poker or gambling

No... but it might just take awhile, if ever, for the law to catch up with you. I'd be cautious... you could win big but never collect if the government gets involved in freezing bank accounts, etc.

Currently, it is not illegal but legislation is currently going through the halls of Congress (... instead of the halls of Progress ...) to limit it on a remote basis also. I would search it out on the U.S. Congress page for more information.
