I've heard alot of stories about Illegals crossing into the US to give birth so that there child is a Citizen. Making it harder to deport them. I believe they call them anchor babies. I believe we should do away with that. What do you think?

Hell yes!

That's a BS loophole! I'm going to go stand near the border and any pregnant beaner I see comin over is gettin thrown in a wheelbarrow and tossed back on the other side.

How about when they do that they are given the option to get the hell out with the baby or they get the hell out and the baby is taken away and adopted by taxpaying law abiding citizens.

Do do away would this law would be to obviate a constitutional right. As such, it would take a constitutional amendment for that to change, and there is no way that will happen.

As to the "anchor babies," they are a thing of the past. Prior to the enactment of IIRAIRA (Illegal Immigration Reform and Immigrant Responsibility Act), anchor babies could preclude deportation of illegal parents. Nowadays, however, to avoid deportation, the illegal parent would have to prove to an Immigration Judge that their exclusion from the U.S. would cause an extreme hardship to their U.S. citizen child beyond just the normal 'inconveniences' of being deported. Thus, in general if a child is anywhere under the age of 12, and the illegal parent gets deported, then the IJ is going to tell the illegal that their child can go with them.

The kid, of course, could always return to the U.S. on their own accord being a U.S. citizen. Then when the child turns 18, he/she could then petition for the parents to immigrate to the U.S., but if they've already been through a deportation, their chances of getting here legally are slim.

The point is moot. That is in our constitution, and would require a constititutional change to prevent.

However, I agree with others on this topic. If parents are here illegally, then their off-spring should not benefit from their illegal act. It's like saying a bank robber can put the millions he stole in a trust fund for his children, and that's OK.

I also do not accept the argument that mothers with children born here should be allowed to stay. Sure, the place for children is with their mother. Many parents make the decision to travel from their own country for work or other reasons, and take their children with them. No reason why an illegal alien shouldn't be deported with their American children. When of age, the child would have a right to come back here because they are citizens; but under our own laws, children do not have a right to decide where to live while they are minors.

Parents might also want to leave their American children in the care of legal residents/nationals of this country - again, a choice they can make. But nothing gives them the right to stay here having broken our laws.

If you had a child in Japan would it be Japanese?
If you had a child in Mexico would it be a Mexican?
If you had a child on another planet would it be an alien?

Get a grip people!
Why should they be automatic citizens of AMERICA?
I have yet to see anyone come up with a good reason,just a bunch of bleeding heart crap.
I would like a logical,REASONABLE explanation why we should allow this to continue.

** And to those who think non-citizens are in our military THINK AGAIN!
Not only do you have to be a LEGAL citizen you have to have a high school diploma.
You may have come from another country but unless you are here LEGALLY you CANNOT join our armed forces anywhere!

Giving birth in the U.S. does NOT make it harder to deport an illegal alien. Also, the U.S. citizenship by birth can only be claimed after the child's 16th birthday.

Any one born within the boundaries of the United States is a U.S. citizen, as far as the deportation ......they do deport the parents and at times children stay here with a family member and at times go with their parents...but the deportation does happen....they dont show it in the American channel's but they do I'n the Spanish channel's.

its a ridicuolous suggestion.

for example the alternative to 14th amendment would be what?

both parents legal......

so a child with only one parent legal is what?
who decides.

Please understand how ridiculous these people sound.

1) Most of the people yelling and screaming did nothing, absolutely nothing to become citizens.........all they did was come out of thier mothers #######.

thats it.

2) Besides coming out of a ####### they have done nothing, and yet they cling to the high horse, they think theyre better than someone who came here by choice.

3) Right now there are US soliders dying, many of these are Latino and Hispanics with parents who were illegal. they are not legal? they are not american?

they defend you....you ungrateful......

4) think of all the non citizens in our military also spilling blood to protect our cournty our way of life and you doubt them, you deny them the oppurtunity

this is sick.


Beside the legal issue this is a moral issue......

the 14th amendment is to resolve a racist legal attack on newly freed slaves..........

it has been test in the supreme court. the end.

They should have never been allowed to become citizens in the first place. Deport them ALL.

We certainly should ... it's a travesty of the 14th amendment ... and it's a ridiculous situation that two illegal parents could be deported, but their offspring can't ... there's no rhyme or reason in this at all ....
