From what I understand, technically cops are not allowed to search your car, unless you gave them permission to or if they see it in plain sight (meaning whatever they see when looking into your car without actually going in and searching. In order to physically search your car, I believe they need a warrant. I could be wrong, but this is what i remember from one of my classes.

You may be able to argue in court somehow that the search was "unreasonable." Thus, the evidence (joints) in your cig pack would have to be thrown out and dismissed.

Here's some info I found from nolo.com:

"In practice, this means that the police may override your privacy concerns and conduct a search of your home, barn, car, boat, office, personal or business documents, bank account records, trash barrel, or whatever, IF:

* the police have probable cause to believe they can find evidence that you committed a crime, and a judge issues a search warrant, or

* the particular circumstances justify the search without a warrant first being issued." <-- was there anything that could justify them searching your car, did you look stoned? did you smell like you just smoked?

However, in the end, if you are found guilty, and if it's your first offense, you may be able to get off the hook with probation or community service, but I'm not sure.

Well, it should not be a fine as weed is a hell of a lot less harmful than the booze they are kicking *** with taxes on. I suppose weed being illegal is yet another way our HONEST government keeps the YOUTH from progressing beyond their limited, simple way of thinking. Weed is illegal because the OLD SCHOOL FOLKS still have the power. But their time is drawing to the end.

Vote for me for President in 2008. I'll fix all this bull$hit.

If it was your first offense you should get a slap on the wrist. You might have to do some community service and maybe some probabtion (they'll do that just to get a bunch of money out of you). Go, look respectful, apologize, and be sincere!

misd. probation most likey. Not that big of a deal I don't think. Did you give them permission to search? If not they can't charge you for what the illegally found.

If its a first time offense, then maybe probation. You shouldn't do drugs anyways. They get you in trouble.
