My mother suffered a stroke which left her with rt side weakness, hearing loss, loss of cognitive and comprehension abilities, and speech impairment. She was verbally abused by a nurse which has left her very nervous and scared. She cries hysterically when I try to gather more details about the incident. She suffers from insomnia thinking the nurse is standing over her. please advise.

My mother is able to communicate. her speech is slurred and slow but she can verbalize well with time. The nurse did not allow her to do so and therefore was hollering and screaming at her, pointing her finger at her. Yes another patient in the room witnessed this incident. It was reported and I received several phone calls from the hospital officials (CEO, Ombudsman, Nursing Supvr, Medical Director) offering their apologies.

She is not hallucinative. She is about 85% independent approximately 3 wks after the stroke. This particular hospital stay was 5 wks after the stroke for abdomnal pain.

She is not what you would call elderly. She is in her late 50's.

You can sue just about anyone for just about anything. I guess your question is whether or not you can win?

Without anything except your mother's testimony, I doubt it. She's had a stroke, and I assume she's elderly? A defense attorney will tear her apart on the stand and get the jury to believe that she might be senile. That's all it takes - "might" be senile.

I only ask this next question because I don't have any more details than you gave to us - are you sure that this stroke hasn't effected her in a way that she might be paranoid and having hallucinations? Does she seem lucid in every other way? Did this nurse make you uncomfortable? Did she seem like someone who would be so cruel to an old lady suffering from a stroke?

If your gut tells you that this nurse did what your mother says, at least report her to the hospital so that they will keep a closer eye on her. If anyone else witnessed the abuse, definitely file a lawsuit. The woman should not be caring for anyone and should lose her license.

report the nurse! ensure that your mother feels safe and secure, work out every aspect of this----and heh, if a lawsuit works, go for it!!
