The important question is where are you being tried (State and County)? Generally misdemeanor's are defined as crimes where the maximum punishment is 1 year in jail. That does not mean that that is what you will serve. You may get a lighter sentence based upon your criminal history. Also, in most states you only have to serve two thirds of your sentence as the rest is credited as good behavior.

And sentences of one year or less are generally served in "jail" as oppossed to "prison." However, these are just titles for the institution and time spent in "jail" is not any more pleasant that time spent in "prison."

Lastly, misdemeanor's are crimes. You will have a criminal record.

Generally at the most a misdemeanor at the most can get a year in jail, not prison. That is worse case senario. This depends on whether or not a person has a prior record and the type of offense. If it is a first offense the punishment will be less than say if it is your third, fourth, fifth, etc offense.

Usually misdemeanors are treated far different than Felony's. and you don't lose some rights, like voting, In addition, many employers asked about felonies.

Misdemeanors are criminal convictions!

You can go to jail up to a year and usually be fined up to $1,000. That depends on state laws. And ordered to make restitution!

Jail time for a misdemeanors is not served in a prison!
