okay, a few things she needs to do is:
(and if she has done these things then alright)

#1 she needs a full time job. it doesn't have to be a great job just a full time job.

#2 she needs to rent of buy her own place( find someone willing to do a lease option). don't live with friends or family. the children must have their own rooms if different sexes or can share if same sex. the children can not share a room with an adult.

#3 try to have her own transportation.

#4 have plenty of food in the house.

#5 show that she is following her probation as directed.

#6 go to the local family services and ask for help if she hasn't already. let them know the situation.

#7 get all her proof together that the other grandparents have never had contact until recently.

#8 proof of all of his prior convictions.

she may need to change attorneys if he isn't doing his part to help her. she can asked the judge to change.
she needs to prove to this judge that she is serious.
please, please, please tell her not to get into any situations that will involve the police.
document every visit with the children. do not ever miss a visitation!!!! this can mess up everything she has done to help her.

i wish you and your sister the best of luck with this.

P.S. People who don't really understand how this system works should then not answer this kind of question!!!!!

first of all, i hate to tell all of you people giving answers who think you know so much that at the time a person is arrested the children are given to a relative, if there is one available, these people are not checked out until sometime later. if the relative has a home and a way to provide and keep the children safe then the children are left there. sometime these are not really great people and the homes aren't the best but they are relatives. because the father has as many rights as the mother he can say who he wants to keep the children at the time of arrest.

I am also a single mother on low income. Sometimes, as mothers, we need to go the extra mile to get what's best for the kids. As single parents, we are allowed many different ways to get more of an education past high school. If your sister is worried about something like this, she could go and enroll in a community college. It's a difficult role sometimes, but to prove to the court that you want more for your childrens' lives than just low income is a good way to start. If she is a determined woman, she may enjoy being able to further herself as well. I know it sounds a bit idealistic, but if she doesn't want any more problems, this is a good way to start. Proving that you won't accept second best for yourself is something that does and will prove to the courts that you are the best thing for your kids. Good Luck! :)

I don't know where you live but your local college that give lawyer degrees usually have nonprofit lawyers that have just graduated to help out. Please tell her not to sign anything, just don't sign because she may be giving her rights away. Whatever the situation that took her to jail, if she really wants her kids back she has that right. These kind of people are really evil and have no good intentions for the kids, its usually all revenge and the kids are the ones that get hurt.Tell her not to give up or let go of them.Go to your local court house ask alot of questions, get answers.Call CPS, there 1 800 #s,go to your local human resources office.Someone has to help. She can actually get them back with the police when he is not at home. Please find answers, don't let her lose them. There is justice you just have to find it.Wish you and your sister the best of luck.

And? Is there a question buried somewhere in this hard to read ramble?

OK, step one, don't type in all caps. It's hard to read, and it's considered rude. It's the equivalent of shouting in a spoken conversation.

Step 2, just put in relevant information. Doesn't matter is your sister is black and he is white. If we need to know that, someone will ask.

Now, just ask one question at a time, and don't editorialize. "It feels like we are living the 1900's or something" just distracts from the question.

Your turn. Try again.

First of all in order for your sister to get her kids back she needs to go to therapy. Then she needs to dig up some "stuff" to prove that her husband's parents are not sutiable then she needs to hire a lawyer a good one specialized in child custody. She may need your help to do this. Good luck!

It's not what you want to hear, but they done this for the safety of the children { for what ever reason they gave} and once that happens it would take an act of congress to get them back. I know of someone that had four children taken away from her. She had an attorney and done everything dhs required her to do and now they are adopted out .
