he was turning left and I passed on the right except he turned right. damage to my truck was behind the rear door on a quad cab and his damage was to his passenger side in front of wheel. His inspection expired in 02-06 accident happened on 07-06

so the accident is his fault. his insurance should have paid to fix your car. are you asking if you can sue him or something? i hope not, you are not entitled to something because his inspection was expired, dont be a bastard.

Pennsylvania is a 51%-Modified Comparative Negligence state. The liability will be determined on the facts of the accident alone; his inspection sticker being valid or not may result in a ticket for him, but has no bearing at all on the accident itself.

If you were attempting to pass on the right when it was not safe or legal to do so, you will likely be found majority at fault or the "proximate cause" of the accident. Once you are found at least 51% liable, you are barred from recovery or payments for your vehicle, unless you had your own collision coverage and can handle through your own carrier.

In Pennsylvania, the trailing vehicle is required to yield, unfortunately no matter what dumb things the vehicle in front may be doing.

I recommend you call your own company if you have collision. If not, I'm afraid it's very unlikely your damages will be taken care of. Good luck. Hope everyone is ok.

You need an attorney. Witnesses would help.

If what you state is true, the other driver may be at fault, if you can prove that he turned "right" from the left turn lane.

On the other hand, passing on the right can always be dangerous, and unlawful if you passed on the berm of the road.
As to his sticker, only a citation is in order for that.

The law always considers "driver control" of ones vehicle.

was he insured? r-u insured? who's fault? have you verified his policy coverage -inforce at time of accident. do you have un-insured motorist coverage thru your policy? check it out! it will pay! less about $250.00 ded. get busy! dont be ignorant! file a police report? did p.d investigate.??did you get a copy of his ins. pol. #, exp, his name ,address, phone, dob, dl# get accident report from local p.d. that investigated.or a report form from p.d.??? have you talked to your insurance comp. about this?? well... call them! don't be lazy!
do some research...dont be stupid & lazy... was their a newpaper article about the wreck, pd's reports usually printed in local newspaper , get that!
dont be lazy>have you asked the p.d. to assist you? get on it! dont be so lazy!
you want your money? go do some digging!! get busy! get your money!$$$$

i don't think the sticker has anythign to do with it, did he have his signal on, otherwise it might be your fault, especially if you passed him where there wasn't even a lane

who got the citation?
mostly he'll get citation for expired stickers - not much else
