It depends how they entered this country. Hence, not all illegals that enter this country and marry a us citizen will be granted stay. You have to under stand in 2001 there was a law called section245 which with a 1000 penalty fee, illegals that married U.S. citizen were allowed to stay and granted green card (note the magic word) after an investigation was done. Now if you enter this country illegal and marry a U.S. citizen you will have to leave the country for an undetermined time and still pay the penalty fee. Now my friend you are saying you are having a problem with immigration, you should get in contact with an attorney to better assist you.
I wish you and your wife the best of wishes and I hope she gets her papers....take care

For someone marrying an American, a green card is not automatic. An immigrant visa is not guaranteed. The American must petition for the spouse. If the spouse qualifies and has no ineligibilities or inadmissibilities, he or she can apply either for an immigrant visa or an adjustment of status.
If you have had trouble doing this for seven years, it's because you or your spouse have done something very, very wrong.

You will get green card but you still have file for it. First, you will get a social security number and a work permit within the first month. And by the 3rd or 4th month, you should get a temporary green card. And before the 24th month, you will have to file to lift off the temporary status. When you have green card for 3 years, then you are qualified to apply for a US Citizenship.

it depends on the country enforcing the law. in America, if let's say a Mexican marries an American, the Mexican would get American citizenship, following some procedure, of course... and i think it also works the other way around. if the American wants to move to Mexico, he'd get Mexican citizenship...

If you respect the law, it works for you. Maybe you have had trouble doing this for all this years, it's because you have done something wrong, and you are the only one who really knows. the true.
