and he was involved in a car accident (he is at fault).... Would you sue his insurance? The reason I'm asking is because this happend to my grandfather and now his brothers family want him to sue my grandfathers insurance. I'm just wondering if this is OK for a family member to do. I'm feeling a little Pissed at him and I'm not sure if I have the right to.

If they wont pay medical bills then its OK, however if its for greed then NO IT IS NOT RIGHT

Don't understand why you use the word "sue"! Every passenger injuried from an accident have the right to claim the insurance from the driver's vehicle insurance who was at fault. All driver are paying more than $1k to insurance company every year, and the insurance cover the driver, passengers and any third parties. So, why should you feel pissed?

If your grandfather's brother was driving wrecklessly, then yes, he put him in danger and if he was injured should at least get his hospital stay paid for. However, if it was only a small accident and no one was really injured, then I would say because they are family they should settle it between themselves and not get the insurance company involved. (Although all accidents should be reported.)

Look your going to need a shyster lawyer or your not going to get a dime. Insurance is by the lawyers, for the lawyers and of the lawyers. It supports their lavish lifestyle and there is no way around them, it's the law. Forget emotion, this is money, you can split it with your brother if you feel guilty.

the insurance co. will pay for any medical expenses. Just don't sue him to make some money. only if your hurt then follow up.
