I drive an oldsmobile....i am a 27 year old woman....i never break the speed limit....i have 2 car seats in my back seat.....my car is usually messy but never terrible...i got pulled over once for having a head light out on high beam...the cop was 'hiding' with his head lights out and pulled me over, but he searched my car.
the other time my car got searched was when i was parked in a vacant lot rolling pennys to deposit....
neither time did i get a ticket, both times they searched my car fror drugs and weapons....WHY did they do tthis?

Having a headlight out is probable cause for pulling you over. Although, they could have just flashed their lights at you. Parked in a vacant lot is suspicious, more probable cause.Why would you sit in a vacant lot? Having a messy car does seem to make cops search you more often than having a nice clean car. Were you rude to them? More probable cause. Some people just look suspicious or look like criminals and get harassed no matter what they are doing. P.S. It is not against the law to search your car without a warrant. If you refuse they can impound your car.

It depends, probably, on where you were when you got pulled over, and what time it was. If it was late, or if you were in an area known for drug activity, them the police have cause to pull you over. They shouldn't be doing a real search, though, all they can do is a 'plain view' search, and they shouldn't be making you get out of the car, either.

If you consenting to the search, then is is legal. If you didn't specifically consent to the search, then you have a "fruit of the poisonous tree" issue (meaning that anything illegal they find cannot be used against you).

They can search in plain sight. A trunk or closed box or glove box is not plain sight. You have the right to say no. They cannot force the issue or make you wait for a warrant unless they have express probable cause (and articulate it - a hunch is not probable cause)

well if you have a headlight out you are going to get pulled over. a messy car just gives them an excuse to check for drugs and weapons. and if you are just sitting in your car in a vacant lot doing something that looks like you are rolling something, then obviously cops are going to be curious. the vast majority of police seem to think that it's their duty to check up on as many people as possible, so it's nothing personal.

Probable Cause.. and GF you have it. The headlamp out, high beams... anything they can do to pull you over to then look for other stuff... warrants, drugs, weapons. the cops in your area must be bored.

Guarentee this won't happen if you drive a nicer, cleaner car. Sad too think, but it's true.

They do it to find drugs and arrest you. But there must be some type of reasonable suspicion based upon facts to search. I suspect that you didn't dare object to them searching it for fear you will be either ticketed or worst. If you have any concern next time, just say you do not want them to seach the car and that you do not give them concent to seach. Call a lawyer in your Town and find out your rights in this situation.

Politely ask them. Find out what about either you or the car triggers a search. Just remember to be polite about it and tell them the reason you want to know is so that you don't keep looking like someone whose car needs to be searched.

A police officer can ask for your permission to search your car, if you refuse to give them permission, they can get a search warrant to search your car. The only time a police officer can search your car or obtain a search warrant is if they have probable cause that there is something illegal in the car.

Its call probable cause, and they can search whenever, people with kids traffic drugs all the time, so the car seats wouldn't detour them. It also depends on youe area, if its a high crime area that would explain a lot.
