I only owned the car for a couple months, and rarely drove it, never had title switched into my name. I signed the bill of sale, yet never received all the money for the vehicle. The kid I sold it to claims he paid me all the money. He filed in court, and I now find out I have a bench warrant. SInce I did not show up in court, does he automaticly own the car? Or is it still mine since I hald the title? Can I repo it, or report it stolen? He has bill of sale, and a bench warrant on me, I have the title, who wins?

You need a lawyer! Failing to appear was STUPID! It certainly won't help your case! Why did you give him a bill of sale without having received payment in full? That was STUPID as well! Most likely he's going to win. You claim that he didn't pay in full, but he has a bill of sale that says otherwise! You'll be held in contempt of court if you don't sign the title over to him.

You've compounded your stupidity by not putting it in your name in the first place. So technically, the previous onwer is the legal owner and you didn't have the right to sell it. That's what the paperwork says, anyway.

But consult with an attorney first before doing ANYTHING else. Do it TODAY!

If you never had the title switched into your name, you didn't have a right to sell it to someone else - you are required to switch the title over, and then turn the new title over to the new seller.

The person you bought the car from, owns the car, unless he signed the back of the title over to you.

He has the bill of sale, you have the title from YOUR purchase . . . which you shouldn't have sold without retitling it. He wins.

ouch i hope you learned a lesson next time you need to give the title with the bill of sale put on the title that you have a lean
you may still own the car but he can say you comitter froud its best to go to the court and pleed stupid for not showing up and hope for the best
by the way when you didnt show up he won the cace he owns the car the best you can do is appeal depending on the amount you may need a layer if you contuinue to ignore this you will end up in jail

You cant sign the title over to him because your name is not on the title.You can not repo it or report it stolen because your name is not on the title. A bench warrant is nothing don't sweat it.But the kid could possibly get his money back,in Arizona anyway.
