My husband was involved in a car accident 3 years ago. He got sleep apenea from neck injury. We have used and settled with other parties insurance - then began with our insurance company - they asked our lawyer for unpaid bills and lawyer office sent them all the bills (paid and unpaid) Which insurnace co then paid all over again and then closed our claim! We figured out what had happened and insurance co got money back but is not reopening claim. Hubby has not recieved medical treatment for nearly a year since the dr's etc wouldnt see him because they werent getting paid..... lawyer and insurance co wants to settle for miniscule sum. What do you think???

That sucks, You are at the mercy of attorney and ins co. If he is not being treated it is hard to prove he has an ongoing problem. Your attorney should have never allowed you to settle with other parties ins.
I assume you are looking for coverage under your underinsured motorist coverage, which will only cover medical.
The attorney wants it closed as attorney fees cannot be covered under underinsured motorists coverage. Your best bet for payment was with the other parties ins coverage. Did the other party's insurance pay up to the policy limits, if not you may be able to re-open that claim but you would need something from a doctor showing you still need treatment.

You do NOT have to settle. Did your attorney give you a reason for settling for "a miniscule sum"?

OTOH, you might have a hard time proving that the apnea was caused by a neck injury - especially if he's overweight, which is what usually causes apnea. . .

Why did you return money you need for medical treatment without an agreement about future bills? It sounds to me like you agreed to a final settlement, even if you didn't realize you were doing so.
