if you are separated from the child's other parent and that parent is involved in the child's life, custody would generally go to that parent.
if both parents pass away, someone will have to apply to the courts for parental rights.
even if you sign a will stating that you want your mom (for example) to be the legal guardian, another party (your sister for example) could take your mom to court for guardianship and win.
even with that said, a will is your best bet to ensure that someone responsible and close to your children will raise them

We're parents. We worry about our kids and what will happen to them when we're gone. Just don't let it become an overwhelming obsession. I did ask my son's godmother if she would take care of him though, should anything happen. At least til my parents could come settle things and take him. She was there when I gave birth and has always cared for him.

You should think about it...it's very important to have this taken care of and documented in a legal document just in case!!

my husband and if something happened to us both my parents and his mom would trade off seasons with kids . My mom the school year and his mom all holidays and school breaks (its harder for us because our parents are on different coasts) and if both my husband and my self and our parents i'd hope my sister would take them and do they trade off thin gwith his sisters ( my sister has 3 kids, his sisters don't have kids)
