Im a legal resident of america and planning to give birth in the US. I want to name my child after her father's family name but he is living outside the US and having a hard time acquiring a US visa so it would be impossible for him to be present at the time of my delivery. Were still not married but planning to after I give birth.

he needs to be present to get his name on the birth certificate but you can still give her his sirname as far as I know, just he can't get his name on the birth certificate unless he is present or you are married, then he doesn't have to be there.

Are you talking about the first name or the last name (surname or family name)? The first name would be no problem -- just go ahead and name him. If you are talking about the last name, then the father would have to give permission to use his family and fill out a form that says he is the father. It might be possible for him to fill out the form in advance and mail it to the hospital. Ask at the hospital where you plan to have the baby.

You can put his name but it will be hard with him not there.
My fiance and I arent married and when I had my baby we had to go through a few things for his last name to be my fiances.
He had to pay $10 dollars to a get some papers noterized and he had to sign alot of stuff stating that he was the father.
They had to see his I.D. and everything to make sure he was who he was saying he was. They said they do that because alot of people can say someone is the father and they truly arent.
He also had to sign the birth certificate.
You might want to talk to the hospital where your having your baby and talk to the people who do the birth certificates and everything before your baby is born.
Good Luck

yes you can give your baby your boyfriends name.....my son has his fathers name and we were not married.....but you need to be absolutely sure you want to do that if your planning on having your boyfriend sign the birthcertificate too bc if he signs it you'll have to get his permission to change your babys name if you ever broke up....but even if he doesnt sign the birth certificate you can name your baby what ever you want....talk to your doctor or take a trip the the maternity ward you'll be having your baby at....they can give you papers that explain all that now so you'll know what you want to do when you have your baby

most of the time he will have to sign the birth certificate or give some form of authorization to have the child use his last name.

I don't see the problem with you naming your child after him. I'm pretty sure you can name your baby anything you want, b/c me and my hubby weren't married with our first son and I was allowed to name him after my husband. CoNgRaTs, I wish the best for you and your b/f and I hope everything works out for you both. ((GoD bLeSs))!!!!! =^..^=
