Mother-inlaw is not paying full amount on 3 credit card payments. They turned them over to a collection agency.

I may not be correct; but I do not believe a credit card company has the ability to place a lien on any piece of property. For a lien a be applied there must be a direct obligation against the piece of property. For example, if she had had a repairman come to the home and fix the electrical wiring but did not pay him, he can place a lien on the property because he has investment in the property for which he was not paid.

The recourse open to the credit card company and the collection agency is to sue in court and have the court issue a judgment against her. Even then the options of the court are limited. They can garnish wages perhaps if state statue allows that and attach a bank account. If she is on social security, I am not certain whether they have the ability to garnish that or not.

If the amount owed is not great, it will not be worth the effort to sue.

However, she is legally obligated to pay the debt. If she is in fact making payments on the debt, I would be very surprised that they would do anything at all.

Only if she offered the mobile home as collateral for credit, otherwise, there would have to be court intervention in order to levy a lien on her mobile home.

Is the mother in law on title to the home? yes if they get a judgement in court. If she is not on title then no way!
