I went to my husbands apt to talk to him and found him heading into the apt with his mistress. He pushed me toward the car and told me to leave this was his place and I was not invited. He turned to tell her something and then turned to come toward me so I kneed him ...un know where and he told her (from the ground) to call the cops and have me arrested. If I felt he was a threat can they still arrest me and can a reverse the charges if I am arrested?

I left before she made the call and made sure I took a swipe of his truck with my fender as I went. He has yet to send the cops out for me but.....

What they would call it is domestic violence or simple assault. You would get simple assault for striking him in the groin and also get a reckless driving for swiping his truck. He would get simple assault for pushing you. Both of you would go to jail but since it was on Private property of an apartment complex the manager would have to sign charges. Since you haven't been arrested yet, that would mean the apt. manager didn't file the charges. Your in the clear but never go over there again and leave his sorry butt alone.

Yes, he can have you charged with battery, unless you are able to convince an officer or the court that you genuinely felt like your life was in immediate danger.
You can also be charged with leaving the scene of an accident without bodily injury.
It's best to avoid situations such as this where your emotions can overcome your reasoning. That's why it's best to remove yourself from the situation immediately. You are asking for trouble by confronting him, even if he has hurt your feelings a great deal. Turn around and never look back. If you must try and salvage the relationship, talk it out over the phone. But it sounds like you should just begin with divorce proceedings and consult an attorney with regard to your criminal actions.

Well, since he doesn't have any lasting injury, I doubt you'll be arrested.
I also suspect that he won't want his situation all "out there" in the open if he pursues it - especially since he won't really have any "damages" (He didn't go to the hospital, right?)
Had you inflicted an injury - and you none, there would have been cause to arrest you, since you "threw the first punch". And since the only other witness would be on his side, it wouldn't have been good for you.
But as it is - no injury, no real proof except his word, and the guilty circumstances involved - My money is on his not persuing this.
Your Whacking his car changes EVERYTHING, though. That was just plain dumb. You can't claim "self-defense", and he even has a witness that you did it. Whether he pursues it is anybody's guess (his moral guilt may still mitagate it there), but should he choose to - you would lose.

Unfortunately, he can have you arrested. Maybe more so for hitting his vehicle and then leaving the scene of an accident. The knee to the groin may not be as much to worry about. He deserved it though! You go girl. (Unless of course, he has his own apartment because he has already left you then maybe you shouldn't go over there. Then he can also get you for harassment and stalking.) Good luck with the police.
Reversing charges...won't happen in this case.

I'm not sure about the kneeing in the groin but side swiping his truck will get you at least a ticket. Since you say he pushed you first they will probably look at it as self defense. My advice is to get a good lawyer, take him to the cleaners, write him off and move on... I know its harder than that but obviously he has designs on the other woman.

Your handling of this situation was atrocious. Both you and your husband committed multiple crimes. The moment he touched you, you should have called for help. While kneeing him may have been self-defense, the fact that you did not retreat from the situation and continued to engage him may show you consented to the combat. If I were you, I would get a restraining order, divorce, get into therapy and stay away from this man for the rest of your life.

It might be possible that you could be arrested for swiping the truck (although at this point it doesn't sound likely), but the other could be considered self defense. I hope you're divorcing this bastard.

You might be able to claim self defense as far as the kneeing goes; but you just admitted intentionally swiping his car as you left which could be used against you.

You put yourself in the wrong by sideswiping his vehicle. You should have just walked away. He was probably bluffing about calling the police, but once you did physical damage to his car, you raised the stakes.
