well i had my daughter and her biological father hasnt seen her since her 1st b-day well i have heard that there is an abandonment law that if the father hasnt seen the child in a sertian amount of yrs then they admatically lose any and all rights is that true? need help please my husband wants to adopt her

we have already decided that she will know that my husband isnt her real father and ive kept pics for her to see and if she ever decides that she wants to meet him in person then we will allow her

I went through the same thing. My husband and I got a lawyer. He then put a summons in the newspaper for the biological dad to claim the kids or forfeit his rights as their father. He had 30 days. Of course, he didn't show up. So my husband adopted my children with no problems. Good luck.

It's true in some states. you'd really be better off asking an attorney. As for the adopting, well, one can't very well adopt their own flesh and blood. But she should have a father, even if it's a step father (and of course he would have to be better than the father. ).! By the way, had I been married, I'd want to adopt her, too. If I was to marry you, I'd gladly adopt her that way and legally.

You need to talk to a lawyer. The laws are different from state to state. But I know of no such law.

Yes, I believe that you can have her adopted by your hubby if you cannot find your ex without a problem. Get a good lawyer.
