My son's dad moved to California, everytime i have to fight to get him back. This time he told me today that i had to meet him in Phoenix,AZ in two days to pick up my son. He is over 4,000 behind in child support. I don't think he can leagally do that i need help. We have standard custody thru Office of the attorney general in Texas.

What does the court signed custody agreement state about picking up and dropping off your son? Does it state who is supposed to pick up the child, and where the pick up is to take place? If so, and your son's father is supposed to deliver your son back to you in TX but he doesn't, you need to file a motion for contempt of court against him. Don't do this until after you get the child back however! (You don't want to tick him off and then have him try to keep your child!) The court might order him to repay you for any costs associated with getting to AZ to pick up the child.

Texas does not recognize child support and visitation in the same orders. They are seperate issues in the eyes of the court. You will have to go back to court to have the visitation order made more specific. The fact that hes owes back support is irrelevant. If you do not follow the visitaiton order he could slap you with an order to enforce. Just as you could with child support he can get you on visitation.

AOG papers are CRAP!!! you need to get an attorny ASAP...he is too far to even be seeing his child ONCE a month.

BUT, AOG papers say that if you aremore than a 100 miles apart it is the MOTHERS job to pick the child up after visitation.

But in this case...he moved not you...and since he lives more than 100 miles away he needs to be sending you certified requests for his time...is he doing that? If not, screw it...keep the child till you go to court.

i think that if they dont pay then you dont have to let him see your son
