A constable keeps harassing me leaving letter and phone messages. On the letter his name on top and Harris County, precinct number and in the letter he states that I should pay this debt or the writ and seize will start on my property. Seems like he is trying to collect for the credit card co. I thought according to the law in Texas the debtor could not seize or garnish your wages in Texas. Please help.

Have you even been served or was a judgment even filed? If not that constable is in deep trouble.

Is he being threatening or harassing in the phone messages or the letters? If so, keep the messages and letters.

Texas does not garnish wages for debts that aren't child support or alimony, student loans and certain taxes.

If you have a bank account, close it. Either open a new one with someone else as the primary or deal in cash.

I've included a link to homestead exemptions for your property. Even though it is a bankruptcy site, the exemptions are the same for a money judgment.

I've also included a link to Texas laws about harassment.

Find out if you have a judgment in your name. You can either look it up online at your county court web site or call your county court clerk.

If you have anymore questions or need more info, please go to the last link and do some reading in the forums. Start in the newbie forum, then do some reading in the credit forum etc. If you have any questions, feel free to post them there.

I'm not sure about Texas but in Tennessee they can send your debts before a judge for collection and garnishments without you being present. so if this is the case then yes he can seize your property if the judge has ordered so

Seems very odd. In the first place, I don't know how anybody can get a lien without a court judgment.
