My husband and I last year was in a serious fight and we went to court and I have a restraning order on him, we have gone through therapy and I have to removed it because during our vacation it came up at the airport. We live in NJ now but it was issued in NY. I cannot get a hold of family court. I keep getting automated systems and now live person. It runs out in October. THanks.

I need to remove a restraining order. Actually I think it is termed Lift it.

I have called them sicne we got back from our vacation on business days and even had 311 patch me in my no response.. But our therapist is working with us since FEb and I believe that he has chnaged for the better. So I just need to know what to do. Should I look at the original restraining order and is there a number I can all or to speak to. Because I has a public defender go in my place and I never even saw or spoke with the judge because he said he would do Anger Management and that was the terms of our agreement.

To begin with you have to attend a 4 hr class on abuse and the effects on children in abusive situations. Then you have to take the certificate from the class and I think it would be a good idea to take a statement from your therapist about the efforts and changes she has witnessed in him, to the original courthouse the order was issued in and petition the court. At least this is what I had to do in Oregon.
I will tell you though that if you do have children expect children services to show up at your house shortly after! If I had it to do all over again I would have just waited til it expired! Children Services told me that the children were not allowed around their father until he complied with "their requirements" I mean jez if I had just let it go it would of expired no red flags raised and certainly alot less $$$!!!!!!

You need to think this decision through before you remove a restraining order. If you have it removed, then the situation goes bad again, they will be less likely to believe you.
If it runs out in October, You could always just let it run out and not turn him in for violating it. It's only a couple of months anyhow. If you do choose to remove it, you could contact the court in writing to find out how to remove the order. I'm sure they would reply with either a letter or a phone call. It's worth a shot if that's what you really want to do.

It's Sunday, maybe that's why you can't reach anyone at the courthouse. Usually they only work Monday through Friday. I would try calling them tomorrow and see what you can do. You may have to go down there in order to have it removed.

Since the restraining order is still in effect, your husband can be arrested for violating the restraining order. You should be careful in that respect.

you have to go back to the original judge and court house. Ask the judge to remove the order, this can be done by simple letter to court outlining the case number the date the parties and your request to remove the order

leave it alone... just cuz you went thru counseling you wanna remove it... a serious fight...??? what does that mean exactly...

men who hit will hit again...

give it time, lets see how well you two get along for awhile...lets see how the next big fight is handled ....

let it be... that is my suggestion... just in case... but, its your life... why is it so important now anyways... are you planning on traveling again... and the truth of the matter is, something bad must have happened for you to have done that, to have requested a court order against him....

right now you may be in a honeymoon phase....

leave it alone for now... wait til the honeymoon is over....

Go to the court and ask for the paper and fill it out and turn it in and if the judge believes you he will remove it. I did this once and it was a huge mistake, so be warned.

If it expires in October. Dont worry about it. Might be a good idea to leave it in place til then. How can ya be sure he wont flip out again? Doya have any idea that domestic violence is the worse kinda violence. Arentcha kinda fond of breathing?
